Please read these Terms of Use (“Terms”) carefully before using the Drift mobile application (the “App”) operated by Basic Apps (“we,” “our,” or “us”). By downloading or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the App.
2. Description of the App
Drift is a micro-decompression wellness application designed to help you take brief, intentional breaks from stress and overstimulation. The App provides touch-based visual experiences, breathwork sessions, micro-puzzles, and ambient soundscapes intended to promote relaxation and mental clarity.
Important: Drift is a wellness and relaxation tool. It is not a medical device, mental health treatment, or substitute for professional mental health care. The App does not provide medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis or emergency, please contact emergency services or a licensed mental health professional.
The App is intended for personal, non-commercial use only.
3. Subscription and Billing
Free Tier
The App is available for free with up to 3 sessions per day.
Premium Subscription
Unlimited sessions and additional features are available through a subscription:
- Billing: Payment is charged to your Apple ID account at confirmation of purchase
- Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Cancellation: You may cancel at any time through your iPhone Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date
- Refunds: All purchases are processed by Apple and subject to Apple’s refund policy. We do not issue refunds directly. To request a refund, visit reportaproblem.apple.com
- Free trials: If a free trial is offered, any unused portion is forfeited upon purchasing a subscription
4. Health and Safety Notice
The App includes visual stimulation effects (moving images, flashing patterns, and light variations). If you have a history of photosensitive epilepsy, migraines triggered by visual stimuli, or similar conditions, consult your doctor before using visual experience features.
The App is designed to be used in short sessions. We do not recommend extended use. Take breaks as needed. Do not use the App while driving, operating machinery, or in any situation requiring your full attention.
5. User Responsibilities
You agree to:
- Use the App only for lawful personal purposes
- Use the App in a safe environment where you can devote your attention to the experience
- Not use the App as a substitute for professional medical or mental health care
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App in any way that could damage, disable, or impair the App
- Attempt to gain unauthorized access to any part of the App or our CloudKit content database
6. Intellectual Property
The App, including all content, features, design, code, and audio content, is owned by Basic Apps and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.
The fonts and audio content used in the App are licensed for use within the App and may not be extracted or used separately.
7. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Drift is a relaxation aid. We make no guarantees regarding the effectiveness of any session for stress reduction, mood improvement, or any other wellness outcome. Individual results may vary.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BASIC APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Termination
We reserve the right to terminate or suspend your access to the App at any time, with or without cause, if you violate these Terms. Upon termination, your right to use the App will immediately cease.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date. Your continued use of the App after changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the United States and the State of Pennsylvania, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Pennsylvania.
